Villarreal, Moreno & Ruiz is experienced in the
prosecution and defense of claims arising from contractual relationships,
alleged business torts, fraud, negligent representations, intentional
interference with business relationships, unfair competition, real estate
litigation, deceptive trade practices claims and defense of claims under the
UCC. The firm represents clients
in state and federal trial and appellate courts.
The firm represented
the former Resolution Trust Corporation and the Federal Deposit Insurance
Corporation during the financial institution crisis of the
early 1990's. Services provided included many that are regularly required by financial institutions,
such as foreclosure proceedings, suits on notes, defense of
bad faith and property damage claims. The firm presently represents financial institutions
in commercial
litigation matters in Texas.
PERSONAL INJURY
Villarreal, Moreno & Ruiz defends and prosecutes personal injury, wrongful
death
and premises liability claims such as those that arise from automobile
accidents and injuries at commercial sites. Much of the defense work is
performed for self-insured entities.
TOXIC TORT-ASBESTOS DEFENSE
Villarreal, Moreno & Ruiz represents a large employer in the defense of mesothelioma claims arising from alleged worksite exposure to asbestos products.
REAL ESTATE
Villarreal, Moreno & Ruiz represents creditors in mortgage finance and real estate-related litigation including actions involving judicial foreclosures; defense of wrongful foreclosure, breach of contract, fraud, usury and breach of duty of good faith and fair dealing claims; suits on promissory notes and sworn accounts; Texas Deceptive Trade Practices Act claims; unfair debt collection practices and fair credit reporting claims; imposition of constructive trusts, declaratory judgments, compulsory arbitration, Texas Residential Liability Act, ad valorem taxes and complaints about loan servicing.
PROPERTY DAMAGE
Villarreal, Moreno & Ruiz represents public utility clients in property damage claims against contractors and others who have damaged underground electrical, gas and water lines and electric facilities.
